1. Acceptance of Terms
By accessing or using BeatFX ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App. CK0 Software, LLC ("Company," "we," "us," or "our") reserves the right to modify these terms at any time.
2. Description of Service
BeatFX is a video editing application that applies speed effects synchronized to audio beats. The App is provided "as is" and "as available" without warranties of any kind, either express or implied.
3. User Responsibilities
You are solely responsible for all content you process through the App. You represent and warrant that you own or have the necessary rights, licenses, and permissions to use any video or audio content you process. You agree not to use the App for any unlawful purpose or in violation of any third-party rights, including intellectual property rights.
4. Intellectual Property
The App, including its technology, features, and design, is protected by patents (pending), copyrights, trademarks, and other intellectual property rights owned by CK0 Software, LLC. You may not copy, modify, distribute, sell, or lease any part of our services or software.
5. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CK0 SOFTWARE, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
7. Indemnification
You agree to indemnify, defend, and hold harmless CK0 Software, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your use of the App or violation of these Terms.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in Delaware.
Privacy Policy
1. Information We Collect
BeatFX processes video and audio content locally on your device. We do not collect, store, or transmit your personal videos, audio files, or processed content to our servers. We may collect anonymous usage analytics to improve the App, such as app crashes, feature usage statistics, and device type.
2. How We Use Information
Any anonymous data collected is used solely to improve the App's performance, fix bugs, and enhance user experience. We do not sell, rent, or share your personal information with third parties for marketing purposes.
3. Data Storage and Security
All video and audio processing occurs on your device. Your content remains on your device and under your control. We implement reasonable security measures to protect any data we do collect, but no method of electronic transmission or storage is 100% secure.
4. Third-Party Services
The App may integrate with third-party services (such as Apple's frameworks). These services have their own privacy policies, and we encourage you to review them. We are not responsible for the privacy practices of third-party services.
5. Children's Privacy
The App is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13, we will take steps to delete such information.
6. Changes to Privacy Policy
We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Effective Date." Your continued use of the App after any changes constitutes acceptance of the new Privacy Policy.
